This english translation of the Terms & Conditions is a service of the Barenboim-Said Akademie. The german version is solely legally binding.
The General Terms and Conditions govern the legal relationship between concertgoers and the Pierre Boulez Saal. They form part of the sales contract for tickets. They also apply to subscribers, to visitor organizations and their members, if no agreement stating otherwise has been made.
The exact opening hours of the ticket office will be announced via public notice. The ticket office will be open on days with performances one hour before the beginning of the event.
From Tuesday to Saturday, one ticket office will be open from 2 pm to 6 pm, except during the 8-week summer break.
The valid concert calendar with the beginning times for all events is published by the Pierre Boulez Saal on its homepage and in its annual brochure. The Pierre Boulez Saal reserves the right to change programs and casts without notice. The Pierre Boulez Saal is not liable for information on posters or other publications issued by third parties (e.g. by ticket agencies such as CTS EVENTIM AG & Co. KGaA, Classictic GmbH or portals such as www.berlin-buehnen.de).
The Pierre Boulez Saal publishes the applicable ticket prices and announces them at the ticket office. Reduced ticket rates will be offered to those entitled upon request and upon presentation of identification, sometimes only at the ticket office, and subject to availability. Reduced-price tickets are only valid in conjunction with the necessary identification. Proof of eligibility must be shown to the ushers at the hall’s entrance. If such proof is not available at the time of entry, the difference in price between the reduced price and full admission must be paid. Information about the nature and the amount of rebates can be obtained from the ticket office.
5.1 Ticket Reservations
Depending upon availability, reservations can be made in writing, via email or phone from the date on which tickets go on sale.
Reservation requests submitted in writing or via email from the beginning of the ticket sale period will be filled in the order they are received. However, there is no legal claim for requests to be filled in this order. Reservations by phone will be accepted from the date on which tickets go on sale. If reserved tickets are not paid for within the period stated in the reservation confirmation (or stated by the sales agent during the telephone reservation process), these will be released for sale again. Partial payments already received will be refunded.
Once they have been paid for, tickets can be mailed to the buyer by regular mail for a shipping fee of currently 3 Euros. The mailing of the tickets is the buyer’s risk. If the time period for mailing the tickets is too short (7 calendar days or less), tickets will be available for pickup at the ticket office until the beginning of the event. If purchased tickets are not picked up, replacements or refunds will not be granted.
5.2 Ticket Sales at the Ticket Office
Tickets are sold for one season in advance by the ticket office, during the times announced in the publications of the Pierre Boulez Saal. The Pierre Boulez Saal reserves the right to limit the number of tickets that may be purchased by any one buyer. Persons with severe handicaps and the necessary official identification may be treated preferentially.
5.3 Internet Ticket Sales
Tickets are sold via www.boulezsaal.de and the SecuTix Webshop integrated within the website. Tickets may paid for via credit card (MasterCard, Visa), Giropay, immediate wire transfer or via gift vouchers.
All transactions will be encrypted in keeping with the latest standards, using SSL 128-Bit. This protocol encrypts the reservation information and protects data against third-party viewers. While the system is working with SSL, the URL will change from http:// to https: and the toolbar of the browser will display a key or lock symbol.
All orders will be processed immediately upon receipt. We recommend printing out the complete data on your transaction and the General Terms and Conditions, and keeping them in an easily accessible place.
5.4 Additional, complementary regulations
The Pierre Boulez Saal reserves the right to modify or supplement the regulations on ticket sales. Such regulations will be published by the Pierre Boulez Saal or will be posted at the ticket offices.
In principle, consumers have a right of rescission regarding any distance selling contracts, and the Pierre Boulez Saal provides the following information about this right, in accordance with the legal template.
6.1 Right of Rescission
You have the right to rescind this contract within fourteen days without giving any reason.
The period for rescission is fourteen days from the day in which you or a third party of your choice, who is not identical with the shipping agent, has accepted delivery of the goods.
In order to exercise your right of rescission, you must submit an unambiguous declaration (e.g. a letter sent by mail, by fax or email) stating your decision to rescind the contract, to us,

You may use the template form of rescission enclosed, which is, however, not pre-formulated. To comply with the time limit, it is sufficient to have mailed or sent the statement of rescission before the end of the fourteen day-period.
6.2 Consequences of Rescission
If you choose to rescind the contract, we are obliged to return all payments we have received from you, including shipping costs (with the exception of additional costs arising from your choice of a different form of delivery other than the standard delivery offered by us), immediately and at the latest within fourteen days of the day on which we have received your declaration of rescission. For such repayments, we will use the same payment method you used for the original transaction, unless something else has expressly been agreed with you; in no case will we charge any fees for such repayments.
We may refuse to return payments until such we have received the returned goods, or until you have proved that you have sent the goods back, whichever takes place first.
It is your obligation to return the goods without delay and in any case within fourteen days from the day on which you inform us of your rescission of the contract, either by shipping them or delivering them personally. To comply with the time limit, it is sufficient to have mailed the goods within fourteen days. You are responsible for the immediate shipping costs when you return the goods. You are only responsible for any loss of value of the goods if this loss of value is due to your handling the goods in a manner which is not necessary to ascertain the state, characteristics and function of the goods.

6.4 Exceptions from the Right of Rescission
There is no right of rescission for contracts concluded via telephone, email or via the internet (cf. Item 5.3 of these Terms and Conditions) with the Pierre Boulez Saal for the purchase of tickets to concerts, operas or similar events. According to § 312g Section 2 S. 1 No. 9 BGB (German Civil Code), there is no right of rescission for distance sales contracts and contracts made outside of places of business regarding services pertaining to leisure activities in which the contract lists a specific date or period for the provision of said services.
In principle, tickets cannot be exchanged or returned after they have been purchased. There is no compensation for unused tickets. Changes in cast or a delayed beginning of the event only entitle customers to return tickets if the change is significant and the responsibility of the Pierre Boulez Saal. In such cases, the price of the tickets will be refunded.
The interruption of an event for reasons that are not within the responsibility of the Pierre Boulez Saal only constitutes a claim for refunding of the ticket price if the interruption takes place before the first intermission or, in cases of performances without intermission, before the first half of the performance is over. The claim can only be made within a year from the date of the performance, by presenting or sending the tickets to the Visitor Service.
If a performance is cancelled without a replacement, the ticket price will be refunded upon presentation of the tickets to the Visitor Service within a year of the date of the performance, either in person or by mail.
Beyond the refund of ticket prices described above, no shipping fees, costs or damages will be refunded to visitors. All other claims are hereby excluded.
If a visitor loses his or her ticket, the ticket office may issue a replacement for the ticket if he or she can show credibly which ticket was originally bought. The holder of an original ticket takes precedence over the holder of a replacement ticket.
Tickets once purchased may not be resold for profit or commercial purposes without prior agreement of the Pierre Boulez Saal. In cases of infringement against this rule, the Pierre Boulez Saal reserves the right to take legal action and annul the tickets. Furthermore, the Pierre Boulez Saal is entitled to exclude those responsible for the infringement against this rule from future ticket sales.
Third parties are not permitted to offer tickets for sale inside the ticket office or elsewhere within the performance venue or on its premises.
Pierre Boulez Saal Gift Certificates can be redeemed for all events (except guest performances) listed on the Pierre Boulez Saal website. The value of the Gift Certificates cannot be redeemed for cash, nor can Gift Certificates be used to purchase other Gift Certificates. Gift Certificates are valid for a period of one year, commencing with the issue date set forth thereon.
If the value of the order exceeds the value or residual value of the Gift Certificate, the customer must pay the balance. Pierre Boulez Saal is not responsible for the loss or theft of Gift Certificates.Gift vouchers for the Pierre Boulez Saal are valid for all events listed on its website (with the exception of guest performances). The value of gift vouchers is not redeemable for cash. Gift vouchers are not valid for the purchase of other gift vouchers. Gift vouchers are valid for a year from the date of issuing printed on the gift voucher.
If the value of the order exceeds the value of the gift voucher or its remaining value, the customer must pay the difference when ordering tickets. If the value of the gift voucher exceeds the value of the order, the value of the gift voucher will be reduced by the order.
The Pierre Boulez Saal will not replace gift vouchers that have been lost or stolen.
The visitor cloakroom and the foyer normally open two hours before the beginning of a performance.
After a performance has begun, there is no right to be admitted to the auditorium. Should a visitor be refused entrance due to his or her late arrival, this does not constitute a claim for a refund of the ticket price.
Any item found inside the Pierre Boulez Saal must be delivered to the ushers or cloakroom staff. The further treatment of the found items will be governed by §§ 978 ff. of the German Civil Code (BGB).
The Artistic Director holds the domestic authority and exercises it with the help of his agents, especially the ushers and house staff.
Instructions issued by the staff of the performance venue must be complied with.
Visitors may be barred from entering the Pierre Boulez Saal if there is reason to assume that they will disrupt the concert performance or disturb other visitors.
Mobile telephones, watches and other technical devices emitting acoustic and/or visual signals must be turned off during the performance. Visitors may be removed from the auditorium in mid-performance if they disrupt it, disturb other visitors or have occupied a seat for which they do not hold a valid ticket. Admission may also be refused to visitors if they have repeatedly failed to comply with the rules laid out in these General Terms and Conditions.
Persons under 16 years of age will only be admitted to the Pierre Boulez Saal if accompanied by a responsible adult. Concerts at the Pierre Boulez Saal are not suitable for children under 6 years of age. This also applies to concerts that are billed as children’s concerts. Children under the age of 6 will be admitted to the Pierre Boulez Saal if accompanied by a responsible adult, but the Pierre Boulez Saal reserves the right to ask visitors to leave the auditorium if they are disturbing the concert.
In the above-named cases, visitors have no claim for a refund of the admission fee or for other costs or damages. Persons who disturb or disrupt concert performances may be removed from the performance venue.
It is not permissible to occupy a seat not specified on the ticket. If a visitor moves to another seat without permission, the Pierre Boulez Saal may claim payment of the difference in price, may require the visitor to take the seat specified on his or her ticket, or may remove the visitor from the performance.
Video and/or audio recordings of any kind of performance by visitors are prohibited. Persons infringing against this regulation may be removed from the Pierre Boulez Saal.
Before and after performances and during the intermissions it is permissible to take photographs of the Pierre Boulez Saal, if these are intended for private purposes only.
The Pierre Boulez Saal may permit specific persons to make video and/or audio recordings during a performance. By attending the event, other visitors declare their permission to potentially being recorded on video and/or audio, and for such images to be broadcast or published. No claim for compensation may be made for such recordings.
All claims for damages suffered by visitors on the premises of the Pierre Boulez Saal are excluded. This, however, does not apply to claims for damages
- resulting from loss of life, limbs or health,
- resulting from the neglect of essential duties (cardinal duties),
- and other damages resulting from a purposeful or grossly negligent neglect of duties by the Pierre Boulez Saal, its legal representatives or agents.
Essential duties are those which must be fulfilled in order to achieve the purpose of the contract. In the case of neglect of essential duties, the Pierre Boulez Saal is only liable for typical, foreseeable damages, if these were caused by simple negligence, unless a visitor has claims caused by a loss of life, limbs or health. These limitations shall also apply to the legal representatives and agents of the Pierre Boulez Saal, if claims are made directly against them.

If the visitors are merchants, the place of jurisdiction for all disputes arising from and in the context of the contract and its implementation is Berlin. If the visitors are merchants, the place of fulfillment for the receiving of concert tickets and for their payment is Berlin.
These General Terms and Conditions and the contractual relationship between the visitors and the Pierre Boulez Saal shall be governed by German law.
These General Terms and Conditions come into effect on May 10, 2017, replacing any earlier versions.
Should one of the clauses of these General Terms and Conditions be invalid, this shall not affect the legal validity of the other clauses.
